Consumer Health Data Privacy Policy

Effective: September 18, 2024

The American Chemical Society (“ACS”) is committed to respecting the privacy of your health data. Our ACS Privacy Policy describes how we handle your personal information generally. This supplemental Consumer Health Data Privacy Policy only applies specifically to individual residents or “Consumers”, as defined under applicable United States privacy laws regarding consumer health data of the States of Washington, Connecticut, and Nevada (“Consumer Health Privacy Laws”).

We collect Consumer Health Data directly from you that you voluntarily share for specific purposes and may disclose it to third parties as described below.

Consumer Health Data Collection, Use, and Processing

For the purposes of this Consumer Health Data Privacy Policy, “Consumer Health Data” is defined under Consumer Health Privacy Laws and includes personal information that is linked or reasonably linked to a Consumer and that identifies the Consumer’s past, present, or future physical or mental health status.

ACS only collects, uses, and discloses such data as needed and mainly in the context of organizing in-person meetings and events to provide you with the products or services that you request or with your consent.

Purposes for Collection and Use

ACS will use Consumer Health Data to organize and conduct in-person meetings and events (e.g., ACS Spring and Fall Meetings) and fulfill your request to provide accommodating menu options and physical accessibility and accommodation needs of the attendees to such meetings and events, to the extent the use of Consumer Health Data is reasonably necessary and proportionate for these purposes.  Where Consumers utilize call centers to discuss meetings or events registration, ACS and our service providers may record or monitor such calls for quality assurance and training purposes. ACS may also use Consumer Health Data identified above for internal reporting and analysis.

ACS may also use the Consumer Health Data category of photos, videos, and voice recordings as part of meeting and event coverage for both archival and promotional purposes.

Processing

ACS may process Consumer Health Data that we collect from you by methods including, but not limited to, collecting, using, storing, organizing, combining (including other personal information we collect from you), erasing, filtering, and transmitting data in accordance with this Consumer Health Data Privacy Policy for the purposes listed above.

Consumer Health Data Disclosure, Sale, and Use for Targeted Advertising

Disclosure

ACS may disclose the categories of Consumer Health Data set forth above, for the purposes described above, with vendors and contractors (third parties) that perform services related to the meetings and events (e.g., suppliers who provide food and beverages throughout a specific event, suppliers who assist with the venue suitability and adaptation for each of the events) and other partner organizations that support such meetings and events, including the creation and management of meetings and events registration site or digital properties, and related email, phone, and other electronic communications, and marketing activities. ACS may also disclose this information to our subsidiaries and affiliates as needed for the facilitation of the meeting or event. In some circumstances, we may also disclose Consumer Health Data: (i) to third parties in connection with a business transaction (such as a merger, acquisition, joint venture, financing or similar); (ii) to third parties in connection with a legal right or obligation (including the establishment, exercise, or defense of legal claims; to comply with laws or to respond to lawful request and legal processes; to protect our rights and property and the rights and property of other, including to enforce our agreements and policies; to detect, suppress, or prevent fraud; to protect the health and safety of us and others; or as required by applicable law); or (iii) to third parties or the public with your consent or at your direction.

Sales and Targeted Advertising

ACS does not sell Consumer Health Data for profit as defined by Consumer Health Privacy Laws, and ACS does not use any Consumer Health Data for targeted advertising.

Your Privacy Rights

Consumer Health Privacy Laws provide certain rights with respect to Consumer Health Data, including rights to access, delete, or withdraw consent relating to such data, subject to certain exception.

The Right to Withdraw Consent

You may have the right to withdraw your consent to the processing activities for your Consumer Health Data.

The Right to Request Deletion

You may have the right to request that ACS delete your Consumer Health Data and that all third parties to whom ACS has disclosed your Consumer Health Data delete such data.

The Right to Access

You may have the right to confirm whether ACS is collecting, sharing, or selling your Consumer Health Data and to access such data.

To Submit Your Privacy Rights Request

To exercise your privacy rights, please submit a request by emailing privacy@acs.org describing your privacy rights request.

Please note that, as permitted or required under applicable law, ACS will take steps to verify your request before processing it. If further information is needed to verify your request, we may ask you to provide additional details.

In some instances, ACS may not be able to fulfill your request. If your rights request is denied, applicable law may entitle you to appeal with us. All appeal requests should be submitted via email to privacy@acs.org.

Updates to this Policy

ACS reserves the right to update this Consumer Health Privacy Policy at any time. When we make changes to this Consumer Health Privacy Policy, ACS will change the date at the beginning of this Policy and post the revised Policy on our website accordingly.  All changes shall be effective from the date of publication unless otherwise specified. Your continued use of the registration site or participation in the meeting or event following posting of changes constitutes your acceptance of such changes.
